Below you will find information about which personal data - i.e. all data that identifies you or makes you identifiable, such as your name, address, e-mail address or user behaviour - we collect during your visit to our site and how it is used. 1. Server data collection
When you visit our website, various server statistics are automatically stored, which your browser transmits to our provider's server. The name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider are logged.
This data is used for the statistical evaluation of visits to our website and cannot be assigned to specific persons.
The legal basis for the data collection is Art. 6 para. 1 lit. f) DSGVO. This data is not merged with other data sources. The IP address is anonymised. Our legitimate interest in collecting this data is based on the fact that we can use the data to optimise our offer for users, e.g. by preventing access from malicious sites or optimising access via certain browsers, and the log of the IP address enables the delivery of the page to the visitor in the first place.
In principle, you have the right to object to this data collection. In this case, however, this is not possible, as it would otherwise be impossible to use the site.
The data is deleted as soon as it is no longer required for the above-mentioned purposes. The deletion takes place regularly every 8 weeks.
1a. Security of data transmission
For the transmission of your data, we use a secure server with SSL technology (Secure Socket Layer) with 128-bit encryption. This means that your data is transmitted to us securely and unreadable for unauthorised persons.
1b. Transmission to third countries (Art. 13 para. 1 f DSGVO)
It is possible that data will be transmitted to third countries via subcontractors or companies associated with them in the course of calling up and using our website and associated offers. Potential risks may include unenforceable data subject rights and a lower level of data protection. We minimise the risk as far as possible by concluding order processing contracts (if such a contractual relationship exists) and standard contractual clauses including effective supplements required by the supervisory authorities.
2. use and disclosure of personal data
2a. General
Insofar as you have provided us with personal data, we use this to answer your enquiries, to advise you and process contracts concluded with you and for technical administration. Except in the cases explicitly mentioned in this declaration, your personal data will only be passed on or otherwise transferred to third parties if this is necessary for the purpose of processing the contract, if this is necessary for billing purposes or if you have given your prior consent. You have the right to revoke your consent at any time with effect for the future, see also section 9 on your data subject rights.
2b. Contract processing
In the context of contracts concluded with you in the context of orders in the online shop, we collect and store the personal data transmitted by you, e.g. name, address for the purpose of contract processing, e.g. also for invoicing.
The data is passed on to banks, for example, in the context of invoicing. The billing data is transferred to the tax office within the framework of the tax law requirements.
Furthermore, we use the sales platform of Shopify, Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. Thus, we also use the Shopify servers and the content delivery network Fastly used by Shopify.
The legal basis for the collection, processing and transfer of the data is Art. 6 para. 1 lit. b) DSGVO in the context of contract processing. The legal basis for the transfer of data to the tax office is Art. 6 para. 1 lit. c) DSGVO.
This data is deleted after expiry of the applicable statutory retention obligations. Insofar as we are not subject to any statutory retention obligations, the data will be deleted when the purpose ceases to apply.
You have the right to information and the right to object to your data stored by us at any time, see below. Section 9 on your data subject rights.
2c. Contact form and enquiry by e-mail
When using our contact form, we collect and store your e-mail address for the purpose of answering your enquiry. The specification of the telephone number for a callback as well as your name are optional.
If you send us an enquiry by e-mail, we collect and store the e-mail address and the data contained in the e-mail for the purpose of answering your enquiry.
Legal basis: If a contractual relationship develops from the enquiry by way of contract initiation or if the enquiry relates to an existing contractual relationship, the legal basis is Art. 6 para. 1 lit. b) DSGVO, as the storage of the data is necessary for the fulfilment of a pre-contractual or contractual obligation. Furthermore, we also have a legitimate interest in accordance with Art. 6 para. 1 lit. f) DSGVO in processing the data for the purpose of communication and answering your enquiries.
The deletion of the data takes place when the purpose of the storage has ceased to exist, i.e. after answering your e-mail/contact form enquiry or when the matter connected with the enquiry has been conclusively clarified. In the case of an existing contractual relationship or a contractual relationship resulting from the enquiry, the data will be deleted after expiry of the statutory retention periods.

2d. Registration
When you register on our website or create a user account, we collect your first and last name, your e-mail address and a password. We need these in order to be able to process your respective orders. We store this data permanently.
The legal basis for the collection and storage of the data within the scope of registration is Art. 6 para. 1 lit. a) as well as Art. 6 para. 1 lit. b) DSGVO within the scope of the fulfilment of the contract.
Deletion takes place when you unsubscribe from our site or revoke your consent to the use of this data, without affecting the lawfulness of the processing carried out on the basis of your consent, unless legal retention periods, e.g. for invoice records, intervene. In these cases, blocking takes the place of deletion.
You have a right of access to your data stored by us at any time, see below. Section 9, also on your other data subject rights.
3. Cookies
The internet pages use so-called cookies in several places. They serve to make our offer more user-friendly, effective and secure. A cookie is a piece of text information that our website places on the end device you are using via the web browser. Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. We also use cookies that recognise your browser when you log in to the customer account and make it easier for you to access the stored content.
The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest results from the fact that we merely facilitate the retrievability of the page for you with the aforementioned cookies, do not collect any tracking data in the process and thus there is no interference with your personal rights and fundamental freedoms.
You can exclude the acceptance of cookies in your web browser. However, this may impair the functionality of the site. For more information on your rights as a data subject, see section 9 below.
These cookies are only valid for the duration of your browser session and are deleted when you end your visit to our site.

3a. Cookie Consent Tool "GDPR/CCPA + Cookie Management"
To obtain your consent, we use GDPR/CCPA + Cookie Management, a product of iSense LLC, 855 Maude Avemountain View, CA, 94043-4021, USA . Provided you give your consent, GDPR/CCPA + Cookie Management will automatically log the following data with iSenseLabs (https://gdprcdn.b-cdn.net/pages/privacy_policy) :
- The IP number of the end user in anonymised form (the last three digits are set to '0').
- Date and time of consent.
- User agent of the end user's browser.
- The URL from which the consent was sent.
- An anonymous, random and encrypted key.
- The consent status of the end user, which serves as proof of consent.
The data stored is used to ensure that web analytics services only collect data with your consent and to document that consent and to create and display cookie statements to end users.
The key and consent status are also stored in the end-user's browser in the cookie "cookieconsent_status" so that the website can automatically read and follow the end-user's consent in all subsequent page requests and future end-user sessions for up to 12 months.
The legal basis for processing your data is Art. 6(1)(c) and (f) DSGVO because we are legally obliged to be able to prove consent and our legitimate interest arises from the fact that this is the only way we can obtain the necessary consent.
4. Google Tools
We use the following "Google services". The responsible party is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Google Ireland transmits data to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, to which we always draw attention.

4a. Google Tag Manager
Our website uses the Google Tag Manager. With this solution, so-called tags are created and updated, which we can then manage. The Tag Manager implements tags from the services we use and thus triggers other tags. The tool itself does not collect any personal data, but is only used for management purposes. However, the tags that are triggered by it may independently collect personal data (see below for more on this). However, the Google Tag Manager does not access this collected data. If the tool is deactivated, the deactivation takes effect for all tags implemented via the tool.
This website uses the web analytics service Google Analytics
Google Analytics uses so-called "cookies" for the purpose of analysing user behaviour on the website and measuring reach. An overview of how Google uses cookies and which cookies are used can be found in this overview.
We also use the technical extension "Google Signals", which enables cross-device tracking. This means that a single website visitor can be assigned to different end devices. However, this only happens if you have logged into a Google service when visiting the website and at the same time have activated the "personalised advertising" option in your Google account settings.
The legal basis for the collection and storage of the data is Art. 6 para. 1 p. 1 lit. a) DSGVO. By giving your consent for the use of Google Anlaytics, you consent to the processing of your data. We have extended Google Analytics on our website by the code "gat._anonymizeIp();" to ensure anonymised collection of IP addresses (so-called IP masking). It is therefore not possible for us to assign the collected analysis data to a specific person.
Data transfer to third countries: The information generated by the cookies about your use of this website is usually transferred to a Google LLC server in the USA and stored there. However, due to the activated IP anonymisation on this website, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
We have concluded EU standard data protection clauses with Google, with which Google proves to us that it complies with appropriate and suitable technical and organisational measures to protect your personal data.
Revocation:
You can revoke your consent at any time by deleting all set (consent) cookies in your browser.
If you do not wish to use "Google Signals", you can deactivate the "personalised advertising" option in your Google account settings.
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser add-on available under the following link.
The aforementioned add-on may not be available when accessing our site via browsers of mobile devices In this case, as well as in general, you can therefore alternatively prevent the use and transfer of data to Google by clicking on this link. Please note that this is a so-called opt-out cookie, which is only valid for www.espuente.com and the respective browser used. If you delete the cookies in your browser history, you will have to click the link again when you visit our site again in order to object to the use of data. The same applies if you call up the page with a different browser.

The data stored by Google is deleted by default within 14 months.
4b. Google Ads
We use AdWords and Google Conversion Tracking, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google AdWords sets a cookie on your computer ("conversion cookie") if you come to our website via a Google ad. These cookies lose their validity after 30 days and thus no personal data is collected by our side that could indicate the identity of the user. However, your IP address is transmitted to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA in the USA, so that they can carry out the evaluations described below for us. We have concluded an order processing agreement with Google, with which Google proves to us that it complies with appropriate and suitable technical and organisational measures to protect your personal data.
As long as the cookie is still active, we can recognise via Google Conversion Tracking when a user visits our site that this user had clicked on the AdWords ad and was thus originally redirected to our site. Each AdWords customer receives a different cookie. The information obtained with the cookies is used solely to create conversion statistics for us as AdWords customers. In this way, we learn the total number of users who clicked on one of our ads and were redirected to a page of ours that was provided with a conversion tracking tag.
The legal basis for the use of the conversion tracking cookie is Art. 6 (1) lit. a) DSGVO in the case of corresponding consent.
Revocation and deletion:
You can also revoke your consent at any time by deleting all set (consent) cookies in your browser.
You can prevent the collection of information by generally deactivating the automatic setting of cookies in the browser setting or by setting your browser so that only cookies from the domain "googleadservices.com" are blocked. We cannot rule out the possibility that this may result in restrictions on the usability of our site. You also have the option of deactivating the use of cookies and thus personalised ads in Google's Ads Preferences Manager.

5. Facebook
a. Facebook page
For the purpose of exchanging information with our customers and for the purpose of advertising new products or services as well as for general information about our company and its employees, we operate a so-called Facebook fan page. Customers and interested parties can join this by clicking the "Like" button and thus regularly receive information from our company in their news feed on Facebook. We would like to point out that you use this Facebook fan page and its functions on your own responsibility.
This applies in particular to the use of the interactive functions, such as commenting, sharing, liking (see under "Things you and others do and provide" in the Facebook data policy statement: https://www.facebook.com/policy), as well as information about the devices used by users (e.g. IP addresses, operating system, browser type, language settings, cookie data; see under "Device information" in the Facebook data policy statement: https://www.facebook.com/policy).
For the operation of our Facebook fan page, we use the technical platform and services of Meta Platforms, Inc 1 Hacker Way, Menlo Park, California 94025 USA.
As explained in the Facebook Data Policy under "How do we use this information?", Facebook also collects and uses information to provide analytics services, known as "Page Insights", to Page operators to provide them with insights into how people interact with their Pages and with the content associated with them. This information is used to provide us, as Facebook page operators, with statistical information about the usage of the Facebook fan page.
We have entered into a special agreement with Facebook ("Page Insights Information", https://www.facebook.com/legal/terms/page_controller_addendum), which regulates in particular which security measures Facebook must observe and in which Facebook has agreed to fulfil the data subject rights (i.e. users can, for example, send information or deletion requests directly to Facebook). The rights of users (in particular to information, deletion, objection and complaint to the competent supervisory authority) are not restricted by the agreements with Facebook. Further information can be found in the "Information on Page Insights" (https://www.facebook.com/legal/terms/information_about_page_insights_data).
The data collected about you in this context is processed by Meta Platforms, Inc. and may be transferred to countries outside the European Union. Facebook describes in general terms what information it receives and how it is used in its data rights policy. There you will also find information on how to contact Facebook and on the settings for advertisements. In what way Facebook uses the data from visits to Facebook pages for its own purposes, to what extent activities on the Facebook fan page are assigned to individual users, how long Facebook stores this data and whether data from a visit to the Facebook fan page is passed on to third parties is not conclusively and clearly stated by Facebook and is not known to us.
Meta Platforms, Inc. is able to track that you have visited our fan page and how you have used it by means of the cookies it uses and the information it collects. This also applies to all other Facebook pages as well as when you use the social share buttons, insofar as these are integrated on our website.
Based on this data, content or advertising can be offered tailored to you.
If you wish to avoid this, you should log out of Facebook or deactivate the "stay logged in" function, delete the cookies present on your device and close and restart your browser. This will delete Facebook information that can be used to directly identify you.
This will allow you to use our Facebook fan page without revealing your Facebook identifier, but your IP address will also be collected and cookies will be set again. You can exclude the acceptance of cookies in your web browser. However, this may lead to impaired functionality.
If you access interactive functions of the site (like, comment, share, news, etc.), a Facebook login screen will appear. Once you have logged in, you will again be recognisable to Facebook as a specific user.

We are jointly responsible with Meta Platforms, Inc for the collection or receipt in the course of a transmission (but not the further processing) of "Event Data" that Facebook collects or receives in the course of a transmission by means of the Facebook social plugins that run on our online service for the following purposes:
- Advertising information that matches users' presumed interests and displaying content;
- Delivery of commercial and transactional;
- Improving ad delivery and personalising features and content.
We have entered into a specific agreement with Facebook ("Controller Addendum", https://www.facebook.com/legal/controller_addendum), which specifically sets out the security measures that Facebook must observe (https://www.facebook.com/legal/terms/data_security_terms) and in which Facebook agrees to comply with data subject rights.
Note: If Facebook provides us with measurements, analyses and reports that do not contain any information on individual users and are anonymous for us, then this processing is not carried out within the framework of joint responsibility, but on the basis of a commissioned processing agreement ("data processing conditions", https://www.facebook.com/legal/terms/dataprocessing) the "Data Security Terms and Conditions" (https://www.facebook.com/legal/terms/data_security_terms) and, with regard to processing in the USA, on the basis of standard contractual clauses ("Facebook EU Data Transfer Addendum, https://www.facebook.com/legal/EU_data_transfer_addendum).

The legal basis for the use of the Facebook fan page is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest is based on the fact that we enable customers to have a direct exchange with our company via this social media service, also for complaints, and thus always optimise our service.
The rights of users are not restricted by the agreements with Facebook.

b. Meta Pixel
We use the advertising tools of the social network of Meta Platforms, Inc 1 Hacker Way, Menlo Park, California 94025 USA ("Facebook") for advertising activities on Facebook and Instagram. When you are logged into your Facebook or Instagram account, Facebook uses the information you provided during registration, your Likes and your other user behaviour to determine information such as your interests, on the basis of which you are shown customised advertisements, including from our company. We may also use the categories of information provided by Facebook to determine which groups of users, who are anonymous to us, should see our ads. Depending on your privacy settings, your name may appear in our ads. You can find more information about name display in Facebook Ads here. The same applies to so-called social ads, where your friends are shown that you "like" our page, for example. You can determine whether and how your name is displayed in the privacy settings and there in the advertising settings. You can also generally object to the display of Facebook ads by opting out. In addition, you can click on "x" or "∨" in your timeline to set whether and how our advertising on Facebook is displayed to you in the future. Except in the case of permission granted by you, Facebook will not pass on any personal data from you to us. We can only use Facebook's general evaluation tools to track how many users, subdivided according to general criteria not linked to personal data, have seen our ad, clicked on it or later made a purchase in our online shop/undertook an action on our website (conversion tracking through the so-called visitor action pixel). Please note that there is a possibility that Facebook will in turn assign this data to your account profile, over which we have no control.
Data transmission to third countries: Your behavioural data, as well as the data evaluated via the visitor action pixel, are transmitted to the servers of Meta Platforms Inc. in the USA. We have concluded EU standard data protection clauses with Facebook, with which Facebook proves to us that it complies with appropriate and suitable technical and organisational measures to protect your personal data.

The legal basis for the collection and storage of the data is Art. 6 (1) a) DSGVO if consent has been given.
Objection
If you do not agree or no longer agree, you should make use of the above-mentioned opt-out option, with which you can stop the display of advertisements on Facebook. You can find more detailed information on Facebook's data protection regulations and how Facebook ads work at Facebook.
6. payment service provider
6a. Paypal
Within the framework of the PayPal payment method as well as PayPal via direct debit, PayPal credit card and PayPal via purchase on account, your data is passed on in the payment process to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. By using one of these payment options, you agree to the collection of data by PayPal. You can find out exactly what data PayPal collects from you in their privacy policy https://www.paypal.com/de/webapps/mpp/ua/privacy-full. For the payment options direct debit, credit card or purchase on account via PayPal, a credit check is also carried out by PayPal S.à r.l. et Cie, S.C.A. Please note in particular that PayPal will carry out an identity and credit check https://www.paypal.com/de/webapps/mpp/ua/creditchk when you pay without a PayPal account.
The legal basis for the transfer of your data to PayPal is Art. 6 (1) a) and Art. 6 (1) b) DSGVO, as you consent to the use of the data by PayPal on the one hand and it is necessary on the other hand for the fulfilment of the contract when selecting the aforementioned payment methods.

6b. Stripe
For the payment of the subscription, it is necessary to provide your credit card data or account information (SEPA). We use the payment service provider Stripe for this purpose. Stripe is a service of Stripe Payments Europe Ltd. in Ireland or the US company Stripe Inc. Information on the type, scope and purpose of data processing by Stripe can be found in Stripe's global privacy policy. We do not store any credit card data or account information from you. Only the Stripe customer ID is stored as a token in the user account, through which the proper receipt of payment can be traced.
The legal basis for this data processing is Art. 6 para. 1 p. 1 lit. b) DSGVO, as the data is required for the fulfilment of the booking contract concluded.

7a. Twitter page
For the purpose of exchanging information with our customers and for the purpose of advertising new products or services as well as for general information about our company and its employees, we operate a fan page on the "Twitter" platform offered by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA.
If you call up the page via our website using the Twitter symbol and are logged into your account at the same time, Twitter can directly assign the visit to our website to your Twitter account. If you do not want Twitter to assign your data to your account, you must log out of Twitter before visiting our website.
When you access interactive functions on the site (liking, commenting, sharing, news, etc.), a Twitter login screen will appear. After logging in, you will again be recognisable to Twitter as a specific user.
You can find more information in Twitter's privacy policy at https://twitter.com/de/privacy. You can check the data protection settings in your Twitter account. You can activate the function "Block third-party cookies" in your browser settings. However, blocking cookies may result in limited functionality of the site.
As the operator of our Twitter fan page, we do not collect or process any data beyond this. Further information on Twitter and other social networks and how you can protect your data within the framework of the private settings can be found, for example, at youngdata.de.
The legal basis for the use of the Twitter fan page is Art. 6 para. 1 p. 1 lit. f) DSGVO. Our legitimate interest is based on the fact that we enable customers to have a direct exchange with our company via this social media service, also for complaints, and thus constantly optimise our service.

7b. Instagram page
For the purpose of exchanges with our customers as well as for the purpose of advertising new products or services as well as for general information about our company and its employees, we operate a fan page on the "Instagram" platform. This service is offered on the technical platform and by means of the services of Meta Platforms, Inc 1 Hacker Way, Menlo Park, California 94025 USA (hereinafter "Instagram").
The data controller for persons living outside the United States is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.
If you access the page via our website using the Instagram icon and are logged into your Instagram account at the same time, Instagram can directly assign the visit to our website to your Instagram account.
If you do not want Instagram to assign your data to your account, you must log out of Instagram before visiting our website.
When you access interactive features of the site (liking, commenting, sharing, messaging, etc.), an Instagram login screen will appear. After any login, you will again be recognisable to Instagram as a specific user. The legal basis for the use of the Instagram fan page is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest is based on the fact that we enable customers to have a direct exchange with our company via this social media service, also for complaints, and thus constantly optimise our service.

7c. Linkedin page
For the purpose of exchanging information with our customers and interested parties as well as for general information about our company and its employees, we operate a fan page on www.linkedin.com of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland ("LinkedIn"). If you call up the page via our website using the LinkedIn symbol and are logged into your account at the same time, LinkedIn can directly assign the visit to our website to your LinkedIn account. If you do not want LinkedIn to assign your data to your account, you must log out of LinkedIn before visiting our website.

a.Right of objection
